Lindberg and the young girl were taken to the hospital for treatment of neck and back pain and the mother was placed under arrest. She had a blood alcohol concentration of 0.19 percent, which is more than twice the 0.08 BAC needed for a DWI arrest.

She was charged with aggravated DWI under Leandra's Law, which makes it a felony to drive drunk with a child younger than 16 in a vehicle even if you're a first time offender.
