Man Charged with DWI While Driving with his Daughter on Southern State

State police: Father had open beer in car

A man who had been driving drunk with his  2-year-old daughter in the car was arrested on the Southern State Parkway near Massapequa  in the early hours of Sunday morning, state police said.

A  trooper saw the car belonging to Michael Session, 27, of Bayshore, pulled off to the side of the road on the eastbound side of the parkway near the Broadway exit at 3:32 a.m.

The black Acura was still running and when the trooper spoke to Session, he noticed the smell of alcohol coming from the car and spotted an open container of beer, according to police.

He also saw Session's daughter in the rear seat of the car.  

Session failed a sobriety test and his blood alcohol content was at .14 percent, well above New York's legal limit of .08 percent, police said.

He was charged under Leandra's Law with aggravated DWI with a child in the car, and traffic violations.

The child was unharmed and turned over to a family member.
