Massapequa Man Charged With DWI Under Leandra's Law

Father allegedly drove pickup in Amityville with two kids in the truck bed.

A drunk Massapequa man was arrested Sunday night after a cop spotted him driving with two children in the bed of his pickup, Suffolk County police said.

Carlos Rivera, 33, was pulled over after Amityville police officer Justin McElmoyl saw the kids in the truck at about 10:45 p.m.

When McElmoyl got to the 1996 Dodge Dakota, he detected that Rivera had been drinking and placed him under arrest, police said.

The 13 and 7-year-old boys in the bed of the truck were identified as Rivera's sons. The Children were released to family members, police said.

Rivera was charged with aggravated driving while intoxicated with a child passenger 15 years-old or younger (Leandra’s Law) and endangering the welfare of a child.
