A Bayville man was drunk when he crashed his Lexus into a utility pole in Syosset Friday night while his son was a passenger in the car, police said.
Philip Briguglio, 50, is charged with aggravated DWI with a child passenger–a felony under Leandra's Law–and DWI.
The crash occurred at Cold Spring Road and South Woods Road around 9:30 p.m., police said.
Officers who responded to the crash noticed a "strong odor of alcoholic beverage" from Briguglio, police said.
Briguglio was also unsteady on his feet and failed sobriety tests at the scene, police said.
Briguglio's 11-year-old son in the car complained of pain following the crash and was taken to the hospital for evaluation and was later released, police said.
Briguglio will be arraigned on Saturday at First District Court in Hempstead.
