Police: Massapequa Man Drove Drunk With Son in Car

A Massapequa man was arrested Sunday morning for driving while intoxicated with his teenage son in his vehicle in Amityville, Suffolk police said. 

According to police, Amityville Village police officer David Driscoll saw a 2009 Toyota pass through a "steady red light" at Broadway Avenue and Oak Street around 4:10 a.m.

Driscoll pulled over the vehicle and determined the driver, Jairo Penate-Cruz, was intoxicated, police said.

Penate-Cruz’s 15-year-old son was also in the car, police said.

Penate-Cruz, 34, was arrested and charged with aggravated DWI with a child passenger 15 years old or younger, a felony under Leandra's Law, DWI and endangering the welfare of a child.

Penate-Cruz was held in police custody overnight and is scheduled to be arraigned Sunday in First District Court in Central Islip.
