Update: Raymond Roth Arrested Again

"Missing Swimmer" from Massapequa charged with violating order of protection.

The Massapequa man was arrested for the second time in less than 24 hours early Thursday morning, Nassau County police said.

Raymond Roth allegedly violated the against him by his wife Evana.

He had been released on $100,000 bail on Wednesday after being charged with insurance fraud, conspiracy and making a false report after he turned up alive a few days after at Jones Beach. Prosecutors say Roth and his son were trying to cash in on life insurance.

But Roth allegedly called his wife in violation of the order and she notified police. He made three calls to her according to court papers. He did not make threats to his wife, during the calls, cops said.

Police went to a home in Long Beach, where Roth had been staying and arrested him at 12:50 a.m. He's been charged with criminal contempt. At his arraignment Thursday morning, he was ordered held on $10,000 bail.

Evana Roth held a press conference Thursday and said she received the first call at 7:30 p.m.

“It was a number I didn’t recognize. He said 'Hello Evana'. I hung up," she said.

"There were two more calls. He said, 'We have to talk-- the house. we need to discuss what needs to be done.'”

Mrs. Roth said she believed that the calls are "his way of intimidating." 

Her lawyer, Lennard Leeds, said that there is a new order of protection out against Roth.

"Mr. Roth is to stay away from Mrs. Roth, not contact her, not email her," Leeds said.

Evana Roth she was was feeling "uneasy" after receiving the calls. "I don’t know why he’s out. I’m afraid of him," she said. "Just hearing his voice was enough to put me on edge."
